The regulatory position for online medicine sales in India is genuinely unsettled, and almost nobody buying medicines online knows it.
There is no specific regulation governing the online sale and distribution of medicines in India. What applies is the offline framework, extended: a 2015 notice from the Office of the Drugs Controller General stated that the Drugs and Cosmetics Act, 1940 and the Drugs and Cosmetics Rules, 1945 govern online sale as they do any other sale. Draft e-pharmacy rules have existed since 2018 and have not been finalised.
In February 2023 the Central Drugs Standard Control Organisation issued show-cause notices to 20 online pharmacies — including Flipkart, Amazon, Tata 1mg and HealthKart — alleging that they were selling medicines prohibited from sale without a valid prescription. The platforms responded that they act only as an intermediary between consumers and licensed pharmacies, and therefore could not be held liable.
On 16 November 2023 the Delhi High Court directed the Central Government to frame a policy for online medicine sales within eight weeks, observing that the draft rules had been pending for over five years and needed to be expedited.
Why the intermediary argument is the important part. If a platform is the seller, it is answerable for what it sells. If it is an intermediary connecting you to a licensed pharmacy, then the pharmacy is the seller and the platform is a technology layer. That distinction determines who is responsible for verifying your prescription, who is accountable for a wrong or substandard product, and who you are actually dealing with when something goes wrong. It is generally disclosed — in the terms, on the invoice — and almost never noticed.
So the practical checks, which take a minute and are worth more than any discount:
Read the invoice. It names the licensed pharmacy that actually supplied your medicine, along with its drug licence number. That entity, not the app, is the seller. Keep it.
Check the batch number and expiry on arrival, against the invoice. This is ordinary practice for medicines bought anywhere and is skipped more often online because the packaging arrives inside other packaging.
Notice whether a prescription was genuinely required. Prescription-only medicines require a valid prescription regardless of channel. A platform that dispenses one without asking is not doing you a favour — it is the exact conduct the CDSCO notices concerned.
Treat cold-chain products with particular care. Insulin, some biologics and certain vaccines have temperature requirements that a general delivery network may not maintain. For these, a physical pharmacy you can see is often the better choice.
